A brief update regarding the latest legal requirements for the hospitality sector, to tackle the rise of Coronavirus.
22 Sep, 2020

As we all await daily updates following the rise of Coronavirus, the hospitality sector including many community organisations, are now facing legal requirements to:

  • Ask at least one member of every party of customers or visitors (up to 6 people) to provide their name and contact details.
  • Keep a record of all staff working on their premises and shift times on a given day and their contact details.
  • Keep these records of customers, visitors and staff for 21 days and provide data to NHS Test and Trace if requested.
  • Display an official NHS QR code poster, so that customers and visitors can ‘check in’ using this option as an alternative to providing their contact details.
  • Adhere to General Data Protection Regulations (GDPR).
  • Close at 10pm from Thursday 24 September.
  • Ensure that your retail and hospitality staff are wearing masks, which are now mandatory.
  • Enforce ‘the rule of six’ and social distancing.

Please note the updated requirements, in place from Thursday 24 September, now includes displaying an official NHS QR code poster, so that customers and visitors can ‘check in’ using this option as an alternative to providing their contact details. You can create a QR code using the link above.

If you would prefer to maintain your own Track and Trace, you can use the free Twine Visitor app that allows you to sign people in on a tablet as they walk in. Have a volunteer at the entrance welcoming and helping people to navigate your safety measures can be reassuring.

Any designated venue that is found not to be compliant with these regulations will be subject to financial penalties.

The ICO has created a detailed Q&A designed for small businesses and organisations that may not have handled data before.
